NWU Conjunctive Use Issues

NWU has been involved in the preparation and development of Conjunctive Use legislation in Nebraska. An Add Hoc committee led by Jack Maddox and Clayton Lukow introduced this new concept to NWU and thus kicked off our participation into its need.

LB-108 was passed after the Governor appointed a committee to review the need for legislation and the committee presented a proposal to the Legislative Committee. This legislation was passed with several protections included in the bill for groundwater users from in-stream flow appropriations.

Most of the water conflicts today revolve around the conjunctive use of water. The Kansas vs. Nebraska suit, Pumpkin Creek conflict, Platte River Cooperative Agreement, South Platte River Compact concerns and the Republican River Compact all revolve around the conjunctive use of water.

How Nebraska addresses this issue will determine the value of much of the property within the state. Too much regulation and property values decline and not enough in some areas, shortages will occur and values will also decline. One size doesn't appear to fit all with the varying hydrologic and geographic areas of the state.

Go-slow is the action plan for NWU; way too much is at stake for landowners.
